Justice!


I have never been a litigous person. I think in all of the deals I have been in I have only sued two or three times. In fact the guys that bought my software company remain some of my closest friends.

But I also do not shy from a fight. My grandfather was a fighter-my Dad is a pacifist. I like to think I have some of both in me.

One thing that has always been important to me is justice. For awhile I thought seriously about becoming a lawyer. When I accepted the fact that the reason was so that I could defend right from wrong I realized that I would have much better luck as a superhero and dropped the idea.

Recently I had to sue a group who would not live up to a contract I had with them. Although the contract was very clear the principle individual refused to comply with our deal-the deal he struck. He wanted to change it-make it more favorable-try to push me in a corner. After many months and countless attempts to resolve the issue it became clear it was all a trick. This guy was not trying to resolve the matter, the law firm defending the guy was not trying to resolve the dispute, they were simply trying to put me into a corner.

At that point it became necessary to sue. We moved the court to issue a preliminary injunction against this guy. To get a preliminary injunction you need to show, among other things, that it is clear you will win on the merits of a case. It requires showing that substantial damage has been done and that the defendent will not be able to remedy the damage. It is very difficult to receive injunctive relief.

Yesterday, following a several month battle, the court approved our motion for injunctive relief. A very good day in the life.
